Please read the General Terms and Conditions carefully before using our services.

1. Introduction

The General Business Terms and Conditions determine the operation of the heartmade.si online shop, the rights and obligations of the user and the online shop, and regulate the business relationship between the online shop and the purchaser.

The purchaser is bound by the General Terms and Conditions valid at the time of the purchase (placing an online order).

The user is made aware specifically of the General Business Terms and Conditions whenever placing an order, confirming their knowledge of them by submitting the order.

2. Laws

The General Terms and Conditions of the operation of the heartmade.si online shop are drawn up in accordance with the Act on Consumer Protection (ZVPot), the Act on Copyright and Related Rights, the recommendations of the Chamber of Commerce and Industry of Slovenia, international e- commerce codes, the Personal Data Protection Act (ZVOP-1), the General Data Protection Regulation of the EU and the Electronic Communications Act (ZEKom-1).

3. Company

The heartmade.si online shop (hereinafter referred to as “the Shop”), is managed by the company Kulinarično svetovanje, Borut Jovan s.p. (hereinafter referred to as “the Provider”), Turje 31, Turje, 1431 Dol pri Hrastniku, Registration number: 3978214000, Tax identification number: SI58802924, which is also an e-commerce service provider (hereinafter also referred to as the Provider or Kulinarično svetovanje, Borut Jovan s.p.). The General Business Terms and Conditions determine the operation, the user’s rights and the business relationship between the Provider and the Purchaser.

4. Availability of information

The Provider undertakes to provide the Purchaser with the following information at all times: a) The identity of the company (the company’s name and head office, registration number), b) Contact details, enabling the user quick and effective communication (e-mail, telephone), c) The essential characteristics of the goods or services d) The accessibility of the articles (each article or service offered on the website should be available within a reasonable time), e) The conditions of delivery of the articles (method, place and time of delivery), f) All prices must be defined clearly and unambiguously, and it must be shown clearly whether they already contain taxes and transport costs, g) The method of payment and delivery, h) The validity of the offer, i) The time limit within which it is still possible to withdraw from the contract and the conditions for withdrawal; in addition, also, if and how much it costs the Purchaser to return the article, j) An explanation of the complaint procedure, including all information about the contact person or customer service.

5. Offer of articles

Due to the nature of online business, the offer of products in the online shop changes and is updated frequently and quickly. All photos, including photos of products, are symbolic. The offer of articles is intended for specialised activities, therefore, it is essential to know the purpose and the consequential needs for the selected form, size and quality. In addition to sales, the Provider also offers advice on the purchase, which is enabled to all Purchasers through the official contacts of the company.

6. Delivery

The delivery time of products in stock is up to 5 working days from the order confirmation for delivery addresses in Slovenia. For products that are currently not in stock, the estimated delivery time is communicated by the Provider to the Purchaser by e-mail or by telephone upon the confirmation of the order. The Provider undertakes to deliver the ordered products to the Purchaser within the agreed time limit, or to inform him of any deviation in advance. The Provider’s contractual partner for the delivery of shipments is the Post of Slovenia. The Provider reserves the right to choose another delivery service if this will enable it to fulfil the order at a lower cost or more efficiently. The ordered products will be delivered by the Post of Slovenia, which will deliver the goods to the selected delivery address. All agreements regarding the direct delivery of goods are made between the Purchaser and the deliverer from the time when the Post of Slovenia takes over the goods
from the Provider.

7. Payment Terms

Means of payment: The seller accepts the following means of payment: PayPal: The Purchaser can make the purchase through the PayPal online platform by logging in with their username and password and making the purchase. In the case of unauthorised use of the PayPal account when purchasing, the Purchaser should follow the instructions provided by the PayPal platform and immediately inform the seller.
Credit cards: The purchase can be paid with VISA, American Express and Mastercard payment cards. In the means of payment selection step, the Purchaser selects the type of payment card from the payment cards menu. The Purchaser enters the card number, validity of the card and the CVC code (the three-digit number on the back of the card). It must be re-entered upon the next purchase. In the case of unauthorised use of the credit card when purchasing, the Purchaser should follow the instructions provided by the credit card issuer and inform the seller immediately.
Cash on delivery: The Purchaser may pay the order on delivery. In this case, the payment is processed by the Post of Slovenia delivery company under its conditions.

8. Prices

All prices include Value Added Tax (hereinafter VAT) of 9.5% or 22%, and are in euros unless stated otherwise explicitly. Prices are valid at the time of placing the order, and in the case of payment with the payment methods referred to above under the conditions referred to above. The purchase contract between the Provider and the Purchaser is concluded at the moment when the Provider confirms the order (the Purchaser receives an email about the “order confirmed” status). From this moment, all prices and other conditions are fixed, and apply to both the Provider and the Purchaser. The Purchaser is obliged to check the accuracy of the data on the issued invoices and to inform the Provider of any errors. The same price applies to all users of the online shop of the company Kulinarično svetovanje, Borut Jovan s.p. on the website www.heartmade.si. Discounts are only applied on official promotions, or with a unique promotional code.

Despite paying constant attention to surveillance to provide the most up-to-date and accurate data, the information on the price may be incorrect. In this case, or in the event that the price of the article changes during the processing of the order, the company Kulinarično svetovanje, Borut Jovan s.p. will allow the Purchaser to withdraw from the purchase.

9. Promotional code

The promotional code offers various benefits for purchases and is limited in time. An active promotional code is published by the Provider in a manner that corresponds to the purpose of the marketing campaign of the Provider.

The Provider does not guarantee that there is an active promotional code at the time of the purchase. Discounts for individual articles and the promotional code are not added together unless the seller provides explicitly for the addition of campaigns, coupons, promotional codes and similar.

10. Purchasing process

In the purchasing process, the following technical steps are available to the Purchaser: Finding an individual product in the offer of products in the online shop; selecting a product to purchase; adding the selected product to the shopping cart; determining the quantity and size of the product to purchase in the shopping cart; reviewing the price of the selected product in the selected quantity, including the tax charged, selecting the method of delivery of the product; selecting the method of payment; reviewing the order with the selected method of delivery of the product and the calculated cost of delivery, if they are charged, and confirming and placing the order, thus completing the purchase.

11. Access to the stored contract

After placing an order in the online shop, the contract or order arrives at the e-mail addresses of the Provider and the Purchaser. In any case, the executed order is stored on the server and at the headquarters of the company, and can be sent again to the Purchaser of the online shop at their request.

12. Limitation of liability

For the Purchaser and the Provider to avoid possible errors and uncertainties regarding the order, purchase, return or delivery, we advise the Purchaser to contact the official contacts of the Provider in the case of any questions. On the day of delivery, we ask the Purchaser that they be available on the phone, so that the delivery service and the Provider as its client can carry out their work without interruption. Kulinarično svetovanje, Borut Jovan s.p. strives with the utmost care to ensure the timeliness and correctness of the data published on the website. In the event of any change, Kulinarično svetovanje, Borut Jovan s.p. undertakes to inform the Purchaser about the changes, and to allow him to withdraw from the contract or replace the ordered article.

13. Returns and product deviations

If the Purchaser receives inadequate or damaged goods, they are obliged to inform the Seller about that within eight days of receipt of the goods. The Purchaser shall return the undamaged goods in the original packaging to the Provider, and the Provider is obliged to send the Purchaser the appropriate goods as soon as possible. If the Purchaser claims the guarantee personally at the company’s location, the Seller is obliged to replace the damaged goods immediately if the complaint is justified and the goods are in stock.

The online shop heartmade.si does not provide a product that would be exactly the same as on the photo from our catalogue. The product may differ in its colour shades, but in no case should the product deviate from the written description in the catalogue by its purpose, form, size, or quality.
